Whiplash and going to court for pain and suffering...??


This is the problem. I had a car accident last February and hurt the left side of my neck. I did physio for about 6 months which didn't help at all. Now, for the last month or so, my left hand and arm becomes numb. My doctor says it's related to my neck but it would be hard to prove it's because of the accident because I already had arthritis in my neck. I'm waiting for a cat scan which could take up to 6 months to get. My lawyer isn't really impressed with my doctor. He says she doesn't do much to help me. He called me yesterday and told me to go see her again because he needs more details. Just whiplash isn't enough. Plus, I am really scared in a car now and I don't go on highways at all. This is really stressing me out. My doctor isn't helping much and my lawyer is after me. What should I do, sometimes, I just feel like dropping everything! Any suggestions would be greatly appreciated?

I have tried changing family doctors and none accept new patients so I have no choice but to keep her.

If you have been treating with this doctor its hard to try to switch now. Your doctor needs to state in her narrative that you sustained permanent injuries that are CASUALLY connected to the accident. If her narrative is unclear, states degeneration or doesn't really specify permanency you are going to have an issue which is why your attorney is bugging you. If you can't get your doctor to do it, speak to your attorney...I'm sure he has doctors that he works with that would be able to write a favorable report. Good luck!

I have had accidents and had to do the same thing you are doing. I would go to another doctor and get evaluated by him because if your doctor is not interested in helping you then its impossible to win in court. I would also get statements from people that know you telling how this has changed your life. Good luck because it can be a very tough battle. I won my case but I had to do a lot of calling and doing things myself.
