I have whiplash from a car accident what do i do when they try to settle? |
I was a passenger in a car when some guy ran a stop sign hit another lady then hit us going about 65 mph. He stopped 75 feet down the road. He didnt say sorry or ask if anyone was hurt or nothing. I suffered whiplash had to have x-rays and get put on medicine. The top of my spine is straight from the muscles being so tense. Should i settle when the insurance company calls or what? I need some help here because i have never had to do any of this. I am not going to settle until i get doctors order that everythings back to normal and im not in pain. Im not just trying to get money but i have no medical insurance so he is paying for that for sure. When the insurance company calls you, do not take their offer but tell them you are being treated for your injuries. When you finish your treatment (with a chiropractor or doctor) give all of your bills (the chiropractor, ambulance, Emergency Room, etc) to the ins company. They will then take those bills and evaluate them against the nature of the crash (they like to look for ways of shorting you of your money) They are going to try and stall you to make you desperate for your money cause they know you are waiting for it. That may take several weeks or months after you finish treatment. But dont fall into that trap. Maybe make payment arrangements with the doctors to keep them off your back for the money (b/c after all YOU are responsible for paying them, not the Ins company) Once they have evaluated what they think a fair settlement amount would be, they will call you to offer it to you. NEVER TAKE THE FIRST OFFER. This is their lowest offer. Be prepared with good arguments as to why you should be awarded more money (IE you had to be out of work for a certain amount of time, it hurt so bad you were miserable, it was very inconvenient for you to have to keep taking off of work to go to the chiro for treatment, blah blah blah). You will negotiate back and forth with the insurance company until you reach a settlement amount. The whole process is a waiting game. They are going to try to make you wait until you get desperate, but what most people dont know is that adjusters have a case load of a certain amount of cases. for all the new cases they get daily, they need to be settling out the older cases. So the longer you make them wait, the more desperate they get too. When they call you with a new offer, tell them, "I'll think about it and call you back." Then wait a couple days and tell them you thought about it and that wont work for you. You drag the process out too cause eventually they will get deperate to close the case and up the money they will give you. If you feel uncomfortable with all of this, you may want to get a lawyer, but that is exactly what they do with the insurance companies, and charge you like 30 % or so of whatever you get awarded. i got 拢3000 for similar. Yes, settle with them since you were not seriously hurt. Make sure you collect all of your medical bills FIRST, make sure they cover that, time off of work, and pain and suffering. This happened to my husband. He received pay for time lost from work, medical bills and THEN got like 1500 for pain and suffering. He just had whiplash. I would seek legal advice on this matter and not Yahoo answers this is prob not the best place to seek it. But as far as accepting a settlement for the insurance company its seems to be better to hold out as long as possible. You need to make sure you are going to be getting enough money to cover your losses for medical expenses, Time off work, and follow up appointments. Don't just see numbers and think ok i am going to take it. look for the long run and make sure you are covering everything. |
