Car accident. can you claim for whiplash? |
My Daughter & Son-in-law were involved in a car accident on Sunday. A car went into the back of them. Both their children and my son-in-law are ok but my daughter suffered whiplash. Can she claim against the other driver and if so what is involved? She didn't go to hospital but went to the dr's on Monday morning after her neck became very painful. Get a solicitor involved. Make sure you are assesseds by a doctor. You can and should claim for whiplash. Depending on the severity, you will be awarded upwards of 拢1,500. No need to go to hospital. BTW the solicitors, which your own insurance company employ will be the cheapest, and your case will be dealt with by a paralegal. So get your own. But beware the National Accident Helpline ambulance chasing tv as advertised on telly - you have to take out a loan to cover their fee in case you lose. Tell her to talk to her insurance company (car) - they will start the process for her. Otherwise she needs to see a solicitor. YES! Firstly she needs to lodge a claim with her own insurance company. They will contact the fault driver and begin the process of compensation. i dont know whats involved in claiming, but if i were her i would try and claim, i was in an accident about 8 years back, (my mum was driving so i cant claim hehe) but i suffered whiplash, and it still effects me today, some days i wake up with a stiff neck, if you daughter was to take your children out to a adventure park such as chessington, she wouldnt be able to go on many of the rides, the stiffness in her neck will be there for a while to come yet, so yeah have a look into claiming, good luck Keep records of it. My daughter got about 800$ plus medical bills for a whiplash she suffered as a passenger in an accident. She had to get physical therapy for about three weeks for it, so it was a substantial issue, but she's fine now, so it wasn't permanent damage. The fact that she was still a minor may have affected the outcome too. DON'T close out the case until you're sure of the full physical effects of the whiplash. My daughter was lucky, some people suffer for the rest of thier lives. Yes you can. This has happened to me (twice). Tell them to lodge a claim with their insurance company. They should handle everything that's needed to make a successful claim. She most definately can.Did the doctor confirm she had whiplash, and put her neck in a brace? If so she needs to contact her insurance company for a claim form or fill one in online or over the telephone. If no joy there contact one of these "no win no fee" people always advertising on t.v.Not sure if its still happening but a few years ago it was a minimum of 拢500.00 if whiplash was diagnosed....worth a try She has three years to make a claim from the date of the incident. If your daughet was a passenger and not a driver, she has a claim against both the third party driver and the driver of the car she was in (your son in law). The best thing to do is to wite now to the third party insurers, and also to your son in laws insurers telling them what she has done. Include a copy letter). She will need documentary evidence from the doctor and/or the hospital and the insurers will want to know of this. The insurers may also send her to a qualified practitioner of thie choice for a medical check up. Absolutely.. Advise their insurance co... they will do all the legal work for you... It is the sort of thing that might not get settled quickly, as time is needed to establish how much damage has been done to her neck, and if any long term effects will be apparent,,, any settlement will depend on these things. Could be anything from a couple of hundred pounds to tens of thousands in a really bad case... Another 1 after a free few hundred quid for xmas all this blaming and claiming is ridiculous She would have to prove that she had a significant injury, by the sound of it this is pretty unlikely! So far it just sounds like someone on the make! My cousin got 拢4,500 for a whiplash injury. i wld say yes see your insurance agent probably but would have been better if she went to hosptial straight away yes, she can claim. I was in a similar accident in August, and still off work due to whiplash. I'm claiming for the inury, but also for loss of earnings I am in the middle of a claim for whiplash. Tell the insurance company what happened obviously when reporting the claim and they will most likely (they have with me anyway) pass their details onto a solicitor who will take it from there. Absolutely can she make a claim for whiplash. I was a passenger of a vehicle that was hit by another vehicle. I too did not go to the hospital because I didn't have any symptoms until 3 weeks later. It has been 11 months and I am still in pain and seeking medical treatment. So far I am up to $32,000 in medical bills and am still suffering and pray that it won't last for the rest of my life. |
