My patients bill of rights have been violated. who can I speak to and what is the first step?


an office manager in my family physician's office has been making false statements and entries in my medical records without my doctors knowledge. These medical records have been subject of review by other doctors who are determining if my current medical disability resulted from an on the job injury and I am afraid that these remarks by her have negatively influenced their opinions.

This is illegal. There are laws called HIPPA. First, contact the State Medical Licensing Dept. and they will definitely check into this. Then, contact a lawyer.

An office manager has NO authority to alter the medical record. Only licensed caregivers' notes will be used to make any determination of medical disability--so I think you can rest easy about that aspect, at least.

First things first: her employer (your doctor) must be made aware of her actions. He is legally responsible for them, but should be given the opportunity to remedy the problem. There are ways to legally make changes to the record--so if she has made changes that do not accurately represent your condition, the doctor can make sure the record becomes an accurate representation.

If you do not get satisfaction in this way, it would be a really good idea to find yourself a lawyer very experienced in handling disability claims. S/he will know the remedies you have under the law.
