Child support custody and rights question? PLEASE HELP!?


My daughter is almost 2 months old. I know I have to submit a paternity test (the affidavit) and I have to goto court because my baby's momma doesn't want me to see my daughter. I have a good attorney, but I don't know if he can get me shared custody which is what I want. I CANNOT afford child support, but I WILL support my daughter when she is WITH ME.

She is a great mother, I know this, but I just want to see my daughter. What are my options? Is there a cheaper attorney I can speak with? Also, she gave my daugher HER last name which furiated me. Will this paternity affidavit fix this?

Advice....PLEASE ??

Depends which State you're in. If you and she are not married and the baby has her name and you never signed parental rights papers, probably not. You may get visitation but not joint custody.

Your plans for child support aren't going to go favorable for you either. The child does not only need to have her needs met when she's with you. She deserves them to be met no matter where she is and if the mother cannot do it alone, then Daddy needs to do his part. This isn't about you or the child's mother. The answer above is also correct. Your tax return can be sent to the mother if you do not keep up with your child support, but more than that, your drivers license can be suspended also until you have repaid outstanding balance of child support payments. I suggest now as a good time to get a job in which you can support your child.

I wish I wasn't getting the feeling that a name is more important to you than the needs of your daughter, and that this is about you winning. And no, the paternity suit will not mean the child will get your name.

One more poor child who will suffer because immature parents can't see beyond their own wants.

Edit: Let me explain something else you seem to conveniently overlook.

You decided you were a man, and you were ready to have unprotected sex. Hopefully you realized what could happen by doing this. That is about you and the mother. But then a helpless child came on the scene and it's not about you and the mother anymore. You and the mother decide to split up. All well and fine, you two dont have to live together. But your responsibilities to the child do not stop because you decide you dont want to be with the mother anymore.

You do not get to decide that since you and mommy separate, that your responsibilities to the child dissolve. What you and mommy do is your business but your relationship and responsibility to the child remain.

You say you cannot afford to support your child. So basically you're saying that you cannot finish what you started, cannot keep commitments and a child not even two months old, is going to pay for your incompetance. How's it feel to know a two month old is able to "deal" with the result of your failure?

If this is all you think you owe your child, you should hand her over to her mom... and go get yourself a dog.

Doesnt matter if you Cannot afford child support or not, you will have to pay it regardless.. the judge will put your *** to work, to make sure you pay it.. they will even take your tax return if you get a refund.. YOU SHOULD WANT TO PAY IT, If she is your child.. IF you dont want to pay child support, then get a good lawyer and go for full custody. Oh yeah, paternity will fix it alright.. maybe next time, protect yourself, use a rubber! No cheap attorney can help get you what you want. Doesnt matter where she lives, you still have to support her.. do you think food, housing, clothes, medical, school, ins. is cheap??? Hell no!! Grow up!

If you cant take the answers then dont ask the questions.. I am 50 yrs old, been there done that.. now like I said, grow up!!!!! I read the questions and between the lines.. pulease!

nothing wrong with having the mothers surname if you weren't married, don't think you should argue this - maybe being a bit more reasonable and less angry you wont need to go to court and fight over your daughter, !!

it seems a bit selfish saying you will only support her when she is with you, a pack of nappies wouldn't cost the earth and babies are very expensive these little gestures will be better than nothing.
