Nursing home broke Dad's leg? |
My father is in a nursing home because he broke his leg. He has 100 days of therapy. He had use about 60 days when the nursing home was pushing him in a wheelchair without his foot elevated and pulled it under the chair and loosened the screws in the plate where he just broke his leg and broke it again below the original break. He had to have another surgery. He now has about 4 wks of therapy left and the dr won't let him back on his leg for at least 7-8 wks. The nursing home says we have to pay, or get Medicaid to help or we can take him home. That's just wrong. They broke the leg. I am just starting chemo therapy and this has me so stressed out. We will be contacting a lawyer, but does anyone know what we can legally sue for? The nursing home stay? Therapy? Anything for all the stress they're creating? broiler....he was in there because he had broken his leg. It was suppose to be elevated when he was in a wheelchair. So by not elevating it, they pulled it under the wheelchair and broke it again below where the dr had placed the plate. negligence, malpractice, emotional suffering, physical suffering or assault... one of those would have to stick/scare them you can legally sue for medical malpractice. Good luck You can sue for the care before and after surgery, including therapy. Anything beyond that is unreasonable and a judge won't allow it. Your lawyer can best advise you as to the actual things and people who may be sued. you know it is very hard to sue a nursing home, nothing against your father but could he have un-elevated his foot alone? good luck. ahhee I see, well good luck there are some bad nursing home out there, and then ther the ones that have to literally take a beateing from the elder patients in there and deal with it on a day to day bases. good luck anyways, medicals bills are not cheap. That's not right. They should be held accountable. But they probably have some law we don't know about on their side. My Mom is in a home recently as her alzhimers is bad. She can no longer feed herself. Feeding her is like feeding a baby. Only worse. They spend 30 minutes with her and 3 others who need help and what they can get down them is all they get. No longer time is alloted for them. But that's another story. Just try to fight for your Dad or maybe get some help from a good friend or relative. If you push they do listen better. It's terrible that here in America we have to put up with such conditions. We should have the utmost respect for older people and treat them as royalty when they become old and ill. God Bless. i used to work at a nursing home and no one gives an f there to isure your dad is taken care of properly you should visit him often like every two days and nag about every little thing so the staff knows you care because they usually asume no one care for them anymore but seriously they dont care about the residents thats why i quit it was too deppresing because the people i took care of i really cared about and they will always be apart of me and im gonna kill myself hopefully before i get there but i hope you win the case but more importantly i hope your dad heals up so u two can spend more time together I would definately consult an attorney. They were very negligent in patient care, I would own someone's but and would definately be seeking charges, there is really nothing you can do about it-i know it was wrong-but you will never get the nursing home to pay for daddy's stay.the only thing you can do is file a complaint for neglect&abuse! Get yourself a lawyer and sue for negligence, Injury, malpractice and pain and suffering. You already have proof from the x-rays of his additional injury to his leg. Go for broke. Hope your dad recovers soon. My best to him. Good luck. To be quite honest, I don't think the nursing home broke your dads leg. It sounds like he has severe osteoporosis. Having the screws come loose from getting your leg pulled from under a chair doesn't make any sense. And this is not even in the same spot. If he was to re-break the leg in the same spot that might be a possibility but for a whole new break? Sorry I just can't picture it. |
