MOLD! Need Help or Legal Advice Please!?

hello my name is rich (27) I鈥檝e been living in VT with my wife (26) and child (8) for three years in an apartment and when we moved in. the apartment was freshly painted everywhere what we didn't know is that in the bathroom the whole ceiling is covered in mold. We didn't realize it one until water stain looking color started to come above the shower. we had gotten into an argument with the landlord about it my wife was the one who knew what it was I didn't and he had told us it wasn't mold. So in another few months that鈥檚 when it started one the whole ceiling turn colors we told the landlord about but nothing came of it. Then I started to have sinus problems and it had gotten worse as weeks past by my daughter also has sinus problems with head aches and we have never had sinus problems in our lives not once. Then I started to get headaches so I went to the doctor and he told me I now have migraines and diagnosed me with migraines. I never had them before my wife has a mucus problem which now makes her vomit every morning and sometimes during the day. All these symptoms are from what I researched today online come from mold. To make this even better it鈥檚 been 3yrs since then and we all have worse conditions. I鈥檓 shocked all that I have read is what we have for symptoms and just a few months ago we had a state inspection and the inspector looked right at the mold and peeling paint and said it wasn't mold. Yeah tell me she knows what she鈥檚 doing and I just find out on a whim. the mold is throughout our bathroom ceiling about 6ft X 5ft what can we do about it all our landlord does is scrap the cracked paint and paints it over again going on its third coat of paint and still is coming back now one I would like some advice on what I need to do to protect my family and get someone to come over here to tell my moron landlord that it is mold and it needs to get out two is there any legal stuff I can do to go after the landlord for be a slum lord. all the migraines I鈥檝e had which have made me lose one job so far and I don鈥檛 want my daughter or wife to be sick or have long term effects I could care less about me but I鈥檓 pissed and I鈥檓 ready for war Help I need advice from somebody who knows more about these things than I do!
Thank you, Rich

Talk to a good lawyer. S/He should be able to tell you what to do. Your landlord is a jerk and I'm pretty sure he can be sued for negligence or fraud or something!

Good luck!

Don't use bleach! This is not epa recommended practice as will be seen in the section on the use of 'biocides' in the document found here: http://www.epa.gov/mold/ Report It

do something fast !!!!! mold can kill !!!

I have mold in the master bathroom. It's not nearly as bad as this and it didn't cause any health problems, but to make it go away a little we used clorox on it. I dont know if that is going to make your problem better, but you could try it. You could try calling some kind of professional cleaner or ceiling cleaner, don't know if something like that exists. Or, if it gets that bad, knock out that part of the ceiling and get it redone

um, i don't know what you can do except have another inspection or move out. but if its really mold, u have to try to get rid of it; an accumulation of mold does grow, depending on what type of mold, it can cause serious health problems that may remain long-term as you had found out the hard way. it can also be some bacteria, there are alot of different types of bacteria that grows on showers and ceilings, you need to get rid of those too becuz inhaling it or once it gets to your immune system, its pretty damaging. go for a check up too, ask them to do some diagnosis and tell your doc about it. if the inspector that you hired really confirmed your suspicions and your lab results come back positive for mold or bacteria infection, go sue your landlord.

Gee! Rich it sounds like you should move house fast. We live in an house in New Zealand. We get mould on the south side of our home.In this part of the world this is the cold side.Three things you can do.Ventilate when possible. Where is VT? Can't you open windows? Clean off Mould using a bleach/water solution. Thirdly and the best thing-a Dehumidifier. These little machines are great, and since having one,I no longer suffer from Asthma or colds. Your appliance store would have these. Good Luck.

mix clorox about 1 part to 4 parts water, spray on the affected wall/ceiling areas and around them. let sit for an hour or so, then wipe down. very effective at killing mold, and delaying any return. as for all the rest of it, you have to prove your symptoms are related to your saying its mold. a doctor would have to confirm mold infection by doing culture and sensitivity testing of secretions, xrays, and perhaps even a bronchoscopy to biopsy or capture true specimen. also multiply that by family. additionally one would have to match the mold in you to the mold you say is in the bathroom. if all that proved out then you could well start a legitimate claim for damages. otherwise you might try a small claims suit, using pictures and doctors visits. you might win out something on a small scale.

mold in itself will cause sniffles and sneezes, watery eyes, itching, etc. etc, because it is a allergen or trigger for histamine release. very few molds cause serious lung infestations, but if they do they can be difficult to cure.
