My apartment has tested positive for high mold levels and lead in the water. Should I get out? |
I have 6 months left of my lease and hate to break it, but I can not risk my health. These are things we did not inspect prior to moving in. I heard of landlord giving notice with a lease that there is mold, lead, etc on the property. Recently, we have become sick (I am specifically allergic to molds, blood test proof) and I experienced a miscarriage twice. After investigating slightly, such as under the carpet, above the drop ceiling, behind a tile, we are now aware what could be a strong catalyst to our illnesses. I wouldnt risk jeopardizing your health at any cost. Although I understand your desire not to break your lease, mold and other toxicities may constitute grounds for "constructive eviction" and may allow you get out of the lease without any penalties or liquidated damages. I'd strongly recommend consulting an attorney who will normally take a case of this nature on a contingency basis - or you can always speak with local legal aid societies (contact your State or County Bar associations). Be sure to take photographs and keep detailed information of the property and your health as you may never know when they'll become relevant in the future. yes, get out right away, mold can kill you. If they dont let you out of the lease move regardless for health reasons and sue if they try to make you responsible for the rent. A landlord can not make your responsible for rent or a lease if the living conditions are not safe. You need to let your landlord know that due to your health concerns, you have to break your lease. I would definitely get out. There may be a clause in your lease about fixing problems like broken windows, etc, and I would definitely say that a health hazard is a problem. get out asap...your health is way more important...you shouldnt have penaltys but it also depends on the agreement you signed...but most of the time thats grounds for being able to move out and not have to pay MOVE OUT ASASP. You or a family member could die. Get out. No, just be aware and follow it daily and follow every new news about it till it completely reduced & decreased. If you don't want to leave before your 6 months are up, mold can be controlled by getting a dehumidifier to rid the air of moisture that allows it to grow. You can do this yourself, and take it with you when you leave. Yes get out right away and also might be a good idea to get a lawyer. You might be able to recoop some medical expenses and suffering money. Take pictures, report and record anything your landlord may say. Have everything in writing. Get out. ASAP. |

The word is mole, not mold. A mole that rises away from your skin when it did not do so before is more suspect then one that has been like that for ages.
