Medicaid Help?


I was involved in a car accident that disabled me 5 years ago. I had gone back to work and lost the insurance and income from disablity. I have since been fired from my job because of problems caused from my injuries. I am trying to get back on medicaid because I am having problems but it is taking forever. If I go to the hospital with these problems and with my history, do they have to accept me and place me on medicaid? Seems to be the fastest way. (that is what they had to do when I was in the accident since I had no health insurance at the time

OK, if you got fired for something related to a disability you're either entitled to sue your employer or you didn't really get fired for anything other than poor performance. It is not legal to fire someone due to physical limitations if they hired you in the first place. Either speak with an attorney or come clean about why you were fired so we can help you.

A hospital cannot refuse to give you care because of your inability to pay. At the hospital, they do have social services workers who can help you apply for the Medicaid. Once you are reinstated onto Medicaid, it will usually go retroactive to the time that you became unemployed.

Now, you should have never have lost your Medicaid because you are still disabled. If a surgeon loses a hand in an accident, the surgeon can no longer perform surgery. Yet, the surgeon can go back to school to study psychiatry and become a psychiatrist and still keep the disability because the surgeon cannot perform surgery. You will need to convince Medicaid that your new job was not related to your old job and that the car accident made it impossible for you to continue your old job. Also, did you pursue the No-Fault insurance claim ? You should be able to receive compensation from the car accident from that.

Medicaid is state funded, therefore, the rules will vary by state. As far as being treated at the hospital, you cannot be refused because of inability to pay if you have a life threatening condition. You would receive treatment to become stabilized, but may then be transferred to a state funded hospital or discharged if not in any immediate danger.

Qualifying for Medicaid is quite variable. Most states require that you spend down some degree of your assests and/or sell your home unless you are married or have children. The best thing to do would be to talk to a social worker in your area who is familiar with your state laws.
