Regarding HIPAA guidelines on correspondence - specifically the information on their envelope.?


I am participating in a lung transplant evaluation at a large hopital. All correspondence arrives with big, bold letters in all caps saying LUNG TRANSPLANT PROGRAM. Then in small type underneath is the hospital's name. I live in a very small town and am active in several very public organizations. Doesn't this envelope alone violate my privacy? At this moment I look quite well and am active so I really don't want to be answering questions from nodding accquaintances asking me how I am. It has already happened several times with the question posed as "I heard you were ill. Is everything all right?" This is a conversation I really don't want to have with someone I only casually know while standing in the produce aisle at the grocery store! Does information transmitted on an envelope violate any Hipaa guidelines???

Technically not in a direct attempt. If the title, name or part of the name of a Hospital, Clinic, Program, Department etc is called "Lung Transplant Program, then you should have known when you went in for treatment that this may be an issue. A direct title leading to a direct conclusion. You should have requested information to be secured when mailed out.
But also, they shouldn't have a direct title as you stated. What you can do is file a civil rights complaint with OCR. this is b/c you feel violated.

More that likely you have signed your rights away by now to them any way. If you are concerned about it contact them and ask for a plain envelope or better yet ask for email.
They did the same thing with the kidney/pancreas transplant team to me. but I don't care who see's it.
