Can I sue?


I had a gallbladder operation. Minor surgery. Went back in total pain. I was supposedly 1% of the population with an extra duct from the liver. So my abs were filling up with bile and I was left like that for twelve hours till they got ahole of my surgeon. Can I sue?

Well for one she should have checked to see if I was part of the minor percentage and second she didnt answer the hospitals calls to her cell for twelve hours. That is disgraceful. It was worse then childbirth. Trust me.

I would initially say no that you can't sue. But as a surgeon they should have done some sort of due diligence when removing your gall bladder if this is a possible thing that has happened before. As far as them not returning the calls, if they were not the surgeon on call then they cannot be faulted for that as surgeons have lives outside of work too. If they were the surgeon on call then you could definitely sue. But in this day and age I would just consult a lawyer because you can pretty much sue for anything these days. Most lawyers will give you a free consultation and they will take the case if they determine that you have one. Most lawyers would not take a medical malpractice case they didn't think they would win. Just research it and find a good medical malpractice lawyer in your area and consult with them.

No how can you sue, your not dead or left with some terrible condition, its not the doctors fault you had a rare thing like the extra duct.

I recommend speaking with an attorney and another doctor to find out if this was negligence and take action.

Since Canadians talk all the time about this free health care they get that we don't have here in America, I don't know. Seems to me that if everything was paid for by the tax payers, your not out any money, just 12 hours of discomfort for a condition that the doctor did not suspect in the first place. I don't think you have a case, but check with an attorney anyway. Canadian law is different than ours.
