Could I sue the doctor for this? (Medical)?


My mother suffered from a bad stomache pain for 4 to 5 days before she really couldn't take it anymore and I had to take her to the emergency room.
She had to do various tests including CT Scan, Ultrasound, and other various blood tests.
After testing, the doctor at the hospital told us that my mother has an infection in her ovaries. (ovary abscess)
The doctor told us that there are only 2 ways that she could've got the infection. First one is through intercourse, and the second one is through a procedure from my mother's gynecologist (who is different from this hospital's doctor).
And my mother believes that the fault is on her gynecologist.
Reason being, a week before she was hospitalized, she had gone an "endometrium tissue" procedure that checks the ovaries. (not sure what the procedure was actually called.)
My mother told the hospital doctor about this fact, and she said that it's a high possibility that the infection could be from the tools that were used on the procedure

The thing about any surgical procedure, a patient signs a consent form stating that they (the patient) understand the risks surrounding the procedure, including infection; this would be brought up in court and absolve a doctor/hospital.

A complications following a procedure is not always because someone did something wrong. Any time you have a procedure infections is always one of the top complications.
I am sorry your Mom is having problems, but I think you would be hard pressed to prove some made mistakes

If your mother had an invasive procedure of some type just a week prior, this may have led to the infection. I don't know if suing is necessarily the answer. To win any large settlement, you need to prove long term injury. With antibiotics, this shouldn't occur. there is pain and suffering, but wouldn't amount to much. I would recommend contacting the first physician with the concern and ask the physcian to perhaps cover resulting medical expenses.

Only if she can prove negligence was involved and it wasn't a commen risk of the procedure. Proving it would be rather tricky.
My mother sued a doctor at one point. However, he left a lap sponge in her after a vaginal delivery (me). So....it was obvious he was at fault at it wasn't a normal complication.

Personally, I wouldn't jump right to sueing him. I would ask him about it and see what he has to say.
