Doctor "accidentally" removed my cervix - What can I do legally? |
I have been having lots of urinary problems, feet nerveness problems, etc since my abdominal hysterectomy three months ago. I went to hospital today and got my surgery medical records and in it, the doctor said that he "accidentally" removed my cervix. He and I had a discussion 2 days before surgery that in no way did I want my cervix removed unless it was diseased, etc. I believe my urinary and feet numbness problems are related to the surgery since the urologist and neurologist ruled out anything on their end. Do you think this would be a case for a malpractice or for pain and suffering. I hate to sue but I may have to live with these conditions the rest of my life. My cervix was not diseased. The cervix gives your organs pelvic support which is why I did not want it removed. Removal of cervix is very complicated and a big part of a hysterectomy. The cervix was noted as healthy. Whether or not you can prove your current medical conditions (thought I would guess the urinary problems would be easy to attribute to the removal) are a result of the removal of your cervix or not, the fact remains... Your doctor "accidentally" removed a part of your body you did not want, or apparently need, removed... He has failed to exercise due diligence in the practice of medicine... I would see a lawyer asap... get yourself a lawyer who deals in malpractice and he can help you with this. doctors dont just "accidentally" remove stuff.. is there a reason you did not want your cervix removed.. why keep it if you lost everything else.. its not good for anything other than getting cancerous..however he could have "nicked" something.. see another surgeon for a second opinion,, feet numbness sounds like siatic nerve or spinal to me.. Ditto on the "go see an attorney" answer. See someone who specializes in malpractice and do so quickly - time me be of the essence. Was your cervix diseased, is what I would ask. It sounds like he discussed the cervix with you before the surgery. Did he have suspicions that the cervix was diseased? I can't imagine that the doctor would tell you he "accidently" removed your cervix. I don't think we're getting the full "skinny" on this story. |

I would say that it is not completely blocked if you are able to expel gas and pass some bm. I would however try a gentle laxative and a stool softner. Give it a day or so, but if any vomiting accu... You could have cysts, which may get bigger and smaller in response to hormonal changes. The discomfort you feel could be ovulation cramps. Some women get those. One thing is not necessarily related... I suggest you continue to see your doctor for follow up care. And maybe even seek out counseling.
