How can my adult son turn over his rights to me?


My son has mental disorders such as Bi polar manic disorder, ADHD, ODD just turned 18 this past june, He was in correctional from the age of 15 through 18 yrs of age off and on. when he turned 18, he started to become more of a handful by getting arrested off and on. He has been charged 9 different times since june. He has a drug and alochol problem. Doesnt want to stay in therapy like he should and cant stay on his meds. Well my son got arrested again, refused a public defender when he went to court, he said he wasnt thinking at the time when he turned the offer down. But my son wants to pled incomptent (sp) not sure how that will work for him but anyways, my son has already shown that he cant even make reasonable life choices. He says he wants to sign over his rights to me so i can help him when it comes to everyday choice making. How can he go about that and can he do that while he is in jail? Any advice would be great appericate it, serious answers only please, thanks.

I forgot to mention that we live in the state of kentucky. His step father and I both have very clean criminal records and neither one of us does drugs nor do we drink. But his natural father has a mental health history and drug and drinking problems.

As another has suggested, you could do the power of attorney or you could petition for conservatorship. I would opt for the latter, POA can be revoked quickly and irrationally. Best of luck to all of you.

Ask his public defender. S/he should be able to advise you.

ask his public defender but Im almost positive he cant be non compos mentis (of unsound mind) I believe he has to be fully aware in order to do it Good luck

Talk to a lawyer and have power of attorney papers drawn up.
